Terms of Service
These terms are written to be read. If anything here is unclear, ask us at dev@pockadot.com before you agree to it.
1. Who we are
PennyPost is operated by Pockadot LLC, a limited liability company organized in the State of Washington, USA ("PennyPost", "we", "us"). These Terms of Service are an agreement between Pockadot LLC and you, the person or company using the service ("you", "your"). By creating an account or using the API, you accept these terms.
2. The service
PennyPost is an email API for transactional email and email to recipients who opted in: receipts, password resets, notifications, and messages your recipients asked for. We provide API keys, sending infrastructure, delivery events and logs, suppression management, and related tooling.
Paid plans are billed as subscriptions with metered usage (a monthly plan plus per-email overage). Payments are processed by Stripe; see Fees and billing.
3. Your account
- Give us accurate account information and keep it current.
- Keep your API keys secret. Anything sent with your keys is your responsibility, so rotate a key immediately if you think it leaked.
- You must have the authority to accept these terms for the entity you sign up on behalf of.
4. Acceptable use
PennyPost exists to keep a clean sending pool. Consent is the rule: every recipient must have asked for, or transacted their way into, the email you send them. The following are prohibited, on every plan, with no exceptions:
- Spam. Unsolicited bulk email of any kind.
- Cold outreach. Emailing people who never opted in, no matter how targeted or personalized.
- Purchased lists. Bought, rented, scraped, or appended recipient lists.
- Phishing, malware, deceptive sender identities, or content that is illegal under applicable law (including CAN-SPAM).
You must honor unsubscribe requests promptly and keep the required email authentication (SPF and DKIM) in place on your sending domains.
5. Enforcement
We monitor delivery health (bounce and complaint rates) automatically. When a sender's metrics degrade, enforcement follows a published ladder: warn, then restrict, then pause.
Our enforcement policy is built on transparency. We make reasonable efforts to provide the specific reason for any enforcement action (a warning, restriction, or pause) and, except in cases of egregious abuse or where we are legally constrained, a window to fix the problem. Appeals go to dev@pockadot.com.
6. Fees and billing
- Current prices are on the pricing page. Plans renew monthly; overage is metered per 1,000 emails and billed with your subscription.
- Payments are processed by Stripe. We never store your full card details.
- We give at least 30 days' notice before a price change affects an existing subscription.
- You are responsible for any applicable taxes.
7. Your content and data
You keep all rights to the content you send. You grant us only the limited rights needed to operate the service: to process, transmit, and log your emails on your behalf. We process recipient data as described in our Privacy Policy. In short: email bodies are not stored after sending, delivery logs are kept for 30 days, and aggregate statistics are kept to run the service.
You are responsible for having the legal basis (consent, or a transaction) to email every recipient you send to through PennyPost.
8. Availability
The service is provided "as is" and "as available", without warranties of any kind, express or implied. We work hard to keep PennyPost up, but we do not guarantee uninterrupted or error-free operation, and we may change, suspend, or discontinue features. Email delivery ultimately depends on third-party inbox providers we do not control.
9. Limitation of liability
To the maximum extent permitted by law: we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim arising out of the service is limited to the fees you paid us in the three months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
10. Termination
You can close your account at any time. We can suspend or terminate your account for violations of the acceptable use policy, for non-payment, or where the law requires it, following the enforcement policy in section 5. After closure, your data is deleted on the schedule in the Privacy Policy. Sections 7, 9, and 12 survive termination.
11. Changes to these terms
We may update these terms as the service evolves. The current version always lives at this page, with its effective date at the top. For material changes we will notify account holders by email before the change takes effect. Continued use after the effective date means you accept the updated terms.
12. Governing law
These terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Washington.
